Court Dismisses Case Against Undocumented Landscaper for Operating a Backhoe Without a Driver's License

Our client was driving a backhoe on a public road momentarily while maneuvering it to an off road location to remove a tree. He was cited for driving without a valid driver's license. The prosecution focused on his undocumented status in the United States. Our firm successfully argued that under Florida law a driver's license is not required while operating farm equipment, regardless of residency, immigration status, or eligibility for a driver's license. The case was dismissed.
