So you've been habitualized. The State of Florida has declared you to be a habitual offender after your third conviction for driving with a suspended license. Three strikes, you're out. Is there hope, or are you doomed to a five year revocation of your driving privileges? Is applying for a hardship license after one year your only option? You may be surprised to learn that in many cases there is actually a way to "un-habitualize" and regain your driving privileges.

Your third strike probably resulted from your plea of guilty or no contest to a charge of driving with a suspended license. At the time of your plea, you probably were not aware that as a result of the plea your license would be revoked. Who would enter a plea if they knew it would result in a license revocation and that other, more favorable options existed for resolving the matter?

Florida law provides a procedure for seeking to vacate a plea that is entered into without full knowledge of the legal consequences, under certain circumstances. This procedure may assist you in "un-habitualizing" by vacating the plea that resulted in the third strike.
